Overview
Welcome to Wicked Wanda's. In these terms, "we", "us", and "our" mean WW Inc. — registered as Wicked Wanda's Adult Emporium Inc. — which operates wickedwandas.ca and our retail store at 327 Bank Street, Ottawa.
"Services" means this store and website, including all related information, content, features, tools, products, and services. Our online store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with the policies referenced in them, describe your rights and responsibilities when you use the Services. They include important information about warranties, liability, and how orders work, so please read them.
By visiting, interacting with, or using our Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
Nothing in these Terms takes away rights you have under Ontario's Consumer Protection Act, 2002 or other consumer protection law that cannot be waived by agreement. Where any part of these Terms conflicts with those rights, those rights win.
1. Age restriction
You must be at least 18 years old to use the Services or to buy from us. This applies to our website and our store, without exception and regardless of where you live.
By using the Services, you confirm that you are 18 or older. Do not allow anyone under 18 to access the Services on your devices or through your account. We may refuse or cancel any order where we have reason to believe the purchaser is under 18.
2. Your account
You do not need an account to shop with us, but you may create one.
To use the Services, you may be asked for information such as your email address and billing, payment, and shipping details. You confirm that the information you give us is accurate, current, and complete, and that you are entitled to provide it.
You are responsible for keeping your account credentials secure and for activity that happens under your account. Do not share your password. Do not transfer, sell, assign, or licence your account to anyone else. Tell us promptly if you think your account has been compromised.
3. Our products
We work hard to represent our products accurately, and our staff know the catalogue well. Even so, colour and appearance can differ from what you see on screen, depending on your device, its settings, and its display. We cannot warrant that a product's appearance will match how it looks in a photograph on your particular screen.
Product descriptions may change at any time. We may discontinue any product, and we may limit quantities available to any person, region, or jurisdiction, case by case.
If you are unsure about anything — size, material, firmness, compatibility, whether a product will do what you want — ask us before you buy. Our returns policy is strict for hygiene reasons, so a question answered beforehand is worth a great deal more than a conversation afterward. We are happy to have that conversation by phone, by email, or in person.
4. Product use and safety
Read and follow the manufacturer's instructions and warnings that come with your product.
Our products are intended for adult recreational use. Unless a product is explicitly described and certified as a medical device, it is not one, and nothing we sell is a substitute for medical advice, diagnosis, or treatment.
Our staff can give you product information — materials, dimensions, mechanics, lubricant compatibility, what customers report. That is product information, not medical advice. If you have a health condition, are pregnant, are recovering from surgery or childbirth, or have any concern about whether a product is appropriate for your body, speak to a qualified healthcare professional.
Use products only as intended by the manufacturer. Pay particular attention to lubricant compatibility, cleaning instructions, and any warnings about materials, since misuse can damage a product and, more importantly, can hurt you.
5. Orders
When you place an order, you are making an offer to buy. We may accept or decline any order at our discretion. Your order is accepted when we confirm it, and we must receive and process your payment before that happens.
Please check your order before you submit it — we fulfil quickly and may not be able to accommodate a cancellation once an order is accepted. If we decline, change, or cancel an order, we will try to reach you using the email address, billing address, or phone number you provided.
Returns and exchanges are governed solely by our Return & Refund Policy, which forms part of these Terms.
Your purchases are for your own personal or household use, not for commercial resale or export.
6. Prices and payment
All prices on wickedwandas.ca are in Canadian dollars.
Prices, discounts, and promotions can change without notice. The price you pay is the price in effect when you place your order, as set out in your order confirmation. Unless we say otherwise, posted prices do not include taxes, shipping, or any customs or import charges.
Prices online may differ from prices in our Ottawa store. Promotions may have their own terms; where those conflict with these Terms, the promotion's terms govern that promotion.
We accept Visa, Mastercard, American Express, PayPal, and Interac. By placing an order you confirm that the payment information you provide is accurate, that you are authorized to use the payment method, and that you will pay the posted price including any shipping and applicable taxes.
Please keep your account and payment information current so we can complete your transactions and reach you if needed.
7. Errors, inaccuracies, and omissions
Occasionally information on the Services may contain a typographical error, inaccuracy, or omission — in a product description, a price, a promotion, a shipping charge, a transit time, or availability.
We may correct any such error and may change, update, or cancel an order affected by it, including after you have submitted it. If we cancel an order for this reason, you receive a full refund. We will not hold you to an obviously wrong price, and we will not charge you one either.
8. Shipping and delivery
Delivery times are estimates, not guarantees. We are not responsible for delays caused by carriers, customs processing, weather, postal disruption, or other events outside our control.
Shipping costs, methods, and delivery details are set out in our Shopping & Returns Policy.
If a parcel is damaged in transit, our Return & Refund Policy tells you what to do and what we will do. Report it within 15 days of receipt.
9. Workshops, events, and gift certificates
These Terms and our Return & Refund Policy apply to workshops, events, and gift certificates sponsored or hosted by us.
Workshops and events
- Workshop and event bookings are final sale and are not refundable or transferable unless we agree otherwise in writing.
- Attendance is 18+, the same as everything else we do.
- If we cancel or reschedule a workshop or event, you may take the new date or receive a full refund. Your choice, not ours.
- We may ask someone to leave an event, without refund, if their conduct is unsafe, harassing, or disruptive to other attendees. Our events are meant to be comfortable for everyone in the room.
Gift certificates
- Gift certificates do not expire.
- They are not redeemable for cash and are not reloadable.
- They can be used online at wickedwandas.ca and in our Ottawa store.
- Gift certificates are non-refundable once purchased.
- We are not responsible for a lost or stolen gift certificate, so treat it like cash.
10. Discretion
Discretion is not a feature we bolt on — it is how we operate. All orders are packaged plainly, our name does not appear on the outside, and the return address reads simply WW Inc. Our order notifications are worded so that a glance at your screen tells nobody anything.
Details are set out in our Shopping & Returns Policy and our Privacy Policy.
11. Intellectual property
The Services — including trademarks, brands, text, displays, images, graphics, video, audio, and the design, selection, and arrangement of all of it — are owned by WW Inc., our affiliates, or our licensors, and are protected under the Canadian Copyright Act, the Trademarks Act, and equivalent laws elsewhere.
These Terms allow you to use the Services for your own personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit material from the Services without our written permission. Nothing in these Terms grants you a licence to any patent, trademark, copyright, or other intellectual property of ours, Shopify's, or any third party's.
Our names, logos, product names, designs, and slogans are our trademarks or those of our licensors. Do not use them without our written permission. Shopify's marks belong to Shopify. Other marks appearing on the Services belong to their respective owners.
12. Reviews and other content you submit
If you submit a review, suggestion, idea, photograph, or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, modify, publish, distribute, and display it in any medium, including commercially — for example, to operate, evaluate, improve, and promote the Services.
You confirm that: you own or have the rights to the Feedback you submit; you have disclosed any compensation or incentive you received for submitting it; and your Feedback complies with these Terms.
We are not obliged to keep Feedback confidential, to pay for it, or to respond to it.
Your Feedback must not infringe anyone's rights — copyright, trademark, privacy, personality, or otherwise — and must not be defamatory, unlawful, abusive, or malicious. Do not use a false email address or impersonate anyone. You are responsible for what you submit, and we take no responsibility for Feedback posted by you or anyone else.
We may, but are not obliged to, monitor, edit, or remove Feedback we consider unlawful, offensive, or otherwise objectionable.
A word on reviews specifically: anything you post publicly is public. Your display name and photo will be visible on our site. Use a name you are comfortable having there — we would rather you thought about it before posting than after. Ask us and we will remove your review.
13. Third-party tools and links
We may give you access to third-party tools we neither monitor nor control. These are provided "as is" and "as available", without warranties, representations, conditions, or endorsement of any kind, and we have no liability arising from your use of them. Using them is at your own discretion and risk, and you should be satisfied with the third party's own terms before you do.
The Services may link to websites operated by third parties, including embedded third-party functionality. We are not responsible for the content or accuracy of third-party materials or sites. If you leave the Services to visit one, you do so at your own risk. Read their policies before you transact with them. Complaints about a third party's products or services should go to that third party.
New features and tools we add in future form part of the Services and are subject to these Terms.
14. Our relationship with Shopify
Wicked Wanda's is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with WW Inc. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and WW Inc., including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with WW Inc.
15. Privacy
Personal information we collect through the Services is governed by our Privacy Policy. Some personal information is also processed by Shopify under the Shopify Consumer Privacy Policy.
Because the Services are hosted by Shopify, information you submit is transmitted to and shared with Shopify and may be processed in countries other than Canada. Our Privacy Policy explains this, along with what we collect, who we share it with, how long we keep it, and what rights you have.
If our Privacy Policy and these Terms conflict on a question of personal information, the Privacy Policy governs.
16. Acceptable use
Use the Services lawfully. You may not use them, directly or indirectly:
- For any unlawful or malicious purpose, or to break any law, regulation, rule, or local by-law
- To infringe our intellectual property rights or anyone else's
- To harass, abuse, insult, harm, defame, disparage, intimidate, or threaten our staff or any other person
- To transmit false or misleading information, or to impersonate anyone
- To send junk mail, chain letters, spam, or unsolicited promotional material
- To do anything that restricts or inhibits anyone else's use of the Services, or that could harm us, Shopify, or other users, or expose any of us to liability
You also agree not to:
- Upload or transmit viruses or other malicious code
- Reproduce, duplicate, copy, extract, sell, resell, or exploit any part of the Services
- Collect or track other people's personal information
- Spam, phish, pharm, or pretext the Services
- Use robots, spiders, scrapers, or other automated means to extract data from the Services at a scale or in a manner that burdens our infrastructure or ignores our published access rules
- Interfere with, bypass, or circumvent our security or authorization measures, robot exclusion headers, or other access controls
We may suspend, disable, or terminate your account if you breach these Terms.
17. Termination
We may terminate this agreement or your access to the Services at our discretion, at any time, and you remain liable for amounts owing up to the date of termination.
These sections survive termination: Intellectual Property; Reviews and other content you submit; Termination; Disclaimer of Warranties; Limitation of Liability; Indemnification; Severability; Waiver and Entire Agreement; Assignment; Governing Law; Privacy — along with anything else that by its nature should survive.
18. Disclaimer of warranties
Information on the Services is provided for general information only. We do not warrant that it is accurate, complete, or useful, and any reliance you place on it is at your own risk.
Except as expressly stated by us, and subject to the paragraph below, the Services are provided "as is" and "as available", without representations, warranties, or conditions of any kind, express or implied, including implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant that your use of the Services will be uninterrupted, timely, secure, or error-free.
This does not apply to the products we sell you. Goods sold to consumers in Ontario carry warranties implied by the Consumer Protection Act, 2002 and the Sale of Goods Act — including that they are of acceptable quality and fit for their ordinary purpose — and those cannot be excluded. We do not attempt to exclude them, and nothing in these Terms should be read as trying to. Manufacturer warranties on the products we sell also apply according to their own terms; our staff will help you make a claim.
19. Limitation of liability
Nothing in this section limits or excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be limited or excluded under Ontario's Consumer Protection Act, 2002 or other applicable law
Subject to that, and to the fullest extent permitted by law:
We are not liable for indirect, incidental, punitive, special, or consequential damages — including lost profits, lost revenue, lost savings, loss of data, or replacement costs — arising from your use of the Services or any product bought through them, whether the claim is in contract, tort (including negligence), strict liability, or otherwise, even if we have been advised such damages were possible.
Where we are liable, our total liability for any claim relating to a product is limited to the amount you paid for that product.
The same limits apply to our partners, directors, officers, employees, affiliates, agents, contractors, service providers, and licensors, and to Shopify and its affiliates.
20. Indemnification
You agree to indemnify, defend, and hold harmless WW Inc., Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims — including reasonable legal fees — payable to a third party and arising out of your breach of these Terms, your violation of any law or third-party right, or your access to and use of the Services.
We will notify you of any claim we seek indemnification for. A delay in notifying you does not relieve you of your obligations unless it materially prejudices you. We may control the defence and settlement of the claim at your expense, including choice of counsel, but will not agree to a settlement that imposes non-monetary obligations on you without your consent, which you will not unreasonably withhold. You agree to cooperate in the defence, including by providing relevant documents.
21. Severability
If any provision of these Terms is found unlawful, void, or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable part will be severed. The rest of the Terms remain valid and enforceable.
22. Waiver and entire agreement
Our failure to exercise or enforce any right or provision of these Terms is not a waiver of it.
These Terms, together with the policies we post on this site, are the entire agreement between you and us regarding the Services, and supersede any earlier agreements, communications, and proposals, oral or written, including previous versions of these Terms.
Ambiguities will not be construed against the drafting party.
23. Assignment
You may not delegate, transfer, or assign these Terms or your rights or obligations under them without our written consent; any attempt to do so is void. We may transfer, assign, or delegate these Terms and our rights and obligations without your consent or notice to you.
24. Governing law
These Terms, and any separate agreement under which we provide you Services, are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada that apply in it.
You and WW Inc. agree to the exclusive jurisdiction of the courts of Ontario, sitting in Ottawa. This does not affect your right to bring a claim in Small Claims Court, or to complain to a regulator, where the law allows.
25. Headings
Headings are for convenience only and do not affect the meaning of these Terms.
26. Changes to these Terms
The current version of these Terms is always on this page.
We may update, change, or replace any part of these Terms by posting an update here, and it is your responsibility to check periodically. Where a change is material, we will notify you as the law requires, and it takes effect on the date given in the notice. Continuing to use the Services after a change means you accept it.
